Welcome to US LuckyCrush ("we", "our", "us", or "the Platform"). These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the US LuckyCrush website, located at us-luckycrush.com, and any associated services, applications, and tools provided by us (collectively, the "Services"). By accessing, browsing, or utilizing the Services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these Terms, you must immediately cease all use of our Services.

1. Eligibility and Age Requirements

Our Services are strictly intended for adult users. 2. Description of the Services

US LuckyCrush provides an online, real-time random video chat routing platform. We utilize advanced peer-to-peer (P2P) WebRTC technology to facilitate instantaneous video and text communications between users globally. The primary function of the Platform is to randomly connect users of opposite genders for social interaction, language exchange, casual conversations, and virtual companionship. We do not guarantee continuous, uninterrupted, or secure access to the Services, as operation may be interfered with by numerous factors outside of our control, including internet connectivity issues and hardware malfunctions.

3. User Conduct and Acceptable Use Policy

As a user of US LuckyCrush, you are solely responsible for your behavior and the content you broadcast or transmit through the Services. We expect all users to maintain a baseline of respect and decency. By using the Platform, you explicitly agree NOT to engage in the following prohibited activities:

• Illegal Activities: Using the Services for any unlawful purposes, including but not limited to the distribution of illicit materials, soliciting minors, or coordinating illegal acts.
• Harassment and Abuse: Engaging in bullying, stalking, intimidation, extortion, threats of violence, or hate speech directed at any individual or group based on race, religion, sexual orientation, gender, or disability.
• Non-Consensual Content: Broadcasting, sharing, or capturing imagery of individuals without their explicit, informed consent. You may not record, screenshot, or distribute the video feeds of other users under any circumstances.
• Spam and Commercial Activity: Transmitting unauthorized advertising, promotional materials, affiliate links, junk mail, spam, or engaging in commercial activities without our prior written consent.
• Platform Abuse: Attempting to bypass our security measures, reverse engineering our routing algorithms, utilizing automated scripts or bots to access the chat, or intentionally attempting to overwhelm our servers via Denial of Service (DoS) attacks.

Violation of any of these rules constitutes a material breach of these Terms and will result in an immediate, permanent ban from the Platform. We actively moderate the Services using a combination of artificial intelligence and human review, and we will cooperate fully with law enforcement authorities regarding any illegal activity conducted via our platform.

4. User-Generated Content and Broadcasting Rights

When you utilize the video, audio, and text chat features of US LuckyCrush, you are creating User-Generated Content ("UGC"). You retain all ownership rights to your UGC. However, by broadcasting on the Platform, you grant us a worldwide, non-exclusive, royalty-free, fully paid, sub-licensable, and transferable license to host, route, transmit, display, and temporarily process your video and audio feeds solely for the purpose of operating and providing the Services to you and your chat partners.

You represent and warrant that you have all necessary rights, power, and authority to grant the aforementioned license for any content you broadcast. US LuckyCrush does not actively record or store your private video chat streams on our servers; feeds are transmitted live via P2P connections or temporary relay servers. However, text logs and generalized usage data may be temporarily retained for moderation and safety purposes in accordance with our Privacy Policy.

5. Account Registration, Credits, and Premium Features

While basic access to the random video chat may be provided without registration, certain advanced features, extended chat durations, or priority routing may require the creation of an account and the purchase of virtual credits or premium subscriptions. If you choose to create an account, you agree to provide accurate, current, and complete information. You are strictly responsible for safeguarding your account credentials.

Virtual Credits and Purchases: Any virtual credits, tokens, or premium features purchased through the Platform are licensed to you, not sold. They have no real-world monetary value and cannot be exchanged for cash or legal tender. All purchases are final and non-refundable, except as required by applicable consumer protection laws. If your account is terminated due to a violation of these Terms, any remaining virtual credits or premium time will be forfeited without compensation.

6. Intellectual Property Rights

All content, features, and functionality of the Platform, including but not limited to the US LuckyCrush logo, website design, text, graphics, user interfaces, software code, routing algorithms, and overall "look and feel," are the exclusive property of US LuckyCrush and its licensors. They are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You are granted a limited, personal, non-transferable, and revocable license to access and use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of our intellectual property.

7. Privacy Policy

Your privacy is highly important to us. Our data collection, usage, and sharing practices are governed by our official Privacy Policy, which is incorporated into these Terms by reference. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, US LUCKYCRUSH DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO GUARANTEES REGARDING THE BEHAVIOR, CONDUCT, OR IDENTITY OF OTHER USERS YOU MAY ENCOUNTER ON THE PLATFORM.

10. Limitation of Liability

IN NO EVENT SHALL US LUCKYCRUSH, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; AND (D) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

11. Indemnification

You agree to defend, indemnify, and hold harmless US LuckyCrush, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms and Conditions; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User-Generated Content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Services.

12. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms, including the formation, interpretation, breach, or termination thereof, shall be referred to and finally determined by binding arbitration in accordance with the rules of the American Arbitration Association. You and US LuckyCrush agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Services immediately.
